By accessing and using EPGEX services ("we", "our" or "the platform"), you ("user" or "you") agree to be legally bound by these Terms of Service. If you do not agree with these terms in their entirety, you must immediately refrain from using our services.

2. Service Description

EPGEX is a digital stock photography platform that provides high-quality visual content under different licensing modalities. We offer images, vectors, and multimedia content for commercial, editorial, and educational use, processing transactions securely through certified payment providers.

3. License Types and Usage Rights

3.1 Editorial License ($4.99)

✓ Permitted Uses:

  • Educational, academic, and research content
  • Journalistic and opinion articles
  • Non-commercial informative blogs
  • Educational presentations and conferences
  • Reference material and documentation

✗ Restrictions:

  • Commercial or promotional use prohibited
  • Not allowed in advertising campaigns
  • Cannot accompany commercial products or services
  • Not authorized for merchandising or resale

3.2 Commercial License ($9.99)

✓ Permitted Uses:

  • Advertising and commercial marketing
  • Corporate and commercial websites
  • Promotional materials and advertising campaigns
  • Commercial social media
  • Commercial printing up to 500,000 copies
  • Digital distribution up to 500,000 views
  • All Editorial License uses

✗ Restrictions:

  • Not allowed in final products for resale
  • Prohibited incorporation into templates for sale
  • Not authorized for merchandising (t-shirts, mugs, etc.)
  • Maximum limit of 500,000 impressions/views

3.3 Extended License ($29.99)

✓ Permitted Uses:

  • Unlimited use in print and digital distribution
  • Physical products for resale (t-shirts, mugs, posters)
  • Digital templates and designs for sale
  • Merchandising and promotional products
  • Use in mobile applications and software
  • Resale as integral part of final products
  • All Editorial and Commercial License uses

⚠ Limitations:

  • Direct resale of unmodified image prohibited
  • Redistribution as stock content not permitted

4. General Usage Restrictions

Regardless of license type, it is PROHIBITED to:

  • Use images in ways that violate third-party rights
  • Create defamatory, obscene, or illegal content
  • Register images as trademarks
  • Sell or sublicense images as independent content
  • Use images containing people without authorization for sensitive commercial purposes
  • Reverse engineer or attempt to identify models or locations

5. User Accounts and Responsibilities

Users must provide accurate information when registering and maintain the confidentiality of their access credentials. They are responsible for all activities performed under their account.

User Obligations:

  • Provide truthful and up-to-date information
  • Keep access credentials secure
  • Immediately report any unauthorized use
  • Comply with all applicable license restrictions

6. Payments, Billing, and Refund Policy

All payments are processed securely through Stripe, complying with PCI DSS standards. Prices are displayed in US dollars (USD) and include all applicable taxes.

Refund Policy:

  • Purchases are generally final and non-refundable
  • Exceptions for verifiable technical errors by the platform
  • Refund requests must be submitted within 48 hours
  • Final decision rests with EPGEX under case-by-case analysis

7. Intellectual Property and Copyright

EPGEX and its contributing licensors retain all copyrights, trademarks, and other intellectual property rights over the content. Acquiring a license grants only the specific usage rights described, not ownership of the content.

Important: The license is personal and non-transferable. Sublicensing content to third parties is not permitted without express authorization.

8. Limitation of Liability and Disclaimer

EPGEX provides the service "as is" without express or implied warranties. We do not guarantee uninterrupted service availability or absence of errors.

Liability Limitations:

  • EPGEX shall not be liable for direct, indirect, incidental, or consequential damages
  • Total liability shall not exceed the amount paid for the content in question
  • We assume no responsibility for user misuse of content
  • User is responsible for verifying content suitability for specific use

9. Modifications and Termination

EPGEX reserves the right to modify these terms at any time. Modifications will take effect immediately upon publication. Continued use of the service constitutes acceptance of modified terms. We may suspend or terminate accounts that violate these terms.

10. Dispute Resolution and Applicable Law

These terms are governed by the laws of the state where EPGEX operates. Any dispute shall preferably be resolved through direct negotiation. In case of legal proceedings, parties submit to the jurisdiction of competent courts.

  2. Good faith negotiation period (30 days)
  3. Mediation or arbitration if necessary
  4. Legal proceedings as last resort
